By using this website (“Service”) you are agreeing to be bound by the following terms and conditions (“Terms of Service”) with The Art Of Driving (50 840 445 228). 

The Art Of Driving reserves the right to update and change the Terms of Service without notice.

These Terms may be varied from time to time and will be updated on the website. You will be bound by the Terms you accept at the time of booking your lesson. If you book more than one lesson at the same time, the terms and conditions applicable at the time of booking will apply to each lesson booked at that time.

1. Fees and cancellations/rescheduled bookings
1.2 We reserve the right to reschedule a lesson subject to the provision of reasonable notice.
1.3 We reserve the right to refuse to provide a lesson where you are unfit to operate a vehicle or suspected to be under the influence of drugs or alcohol as reasonably determined by us. If such circumstances arise, your lesson fee will be payable.

2. Provision of Lessons
2.1 You must hold a current Australian driving licence (Class C LRN or C) or equivalent overseas licence and carry it with you during a lesson.
2.2 On-road lessons commence and end at the pre-determined pick-up point, determined at the time of booking the lesson.
2.3 The duration of a standard on-road lesson is one hour, which includes briefing and/or debriefing time.
2.4 Proper footwear must be worn during the lesson. A flat, enclosed and secure shoe is recommended.
2.5 You must be ready to commence the lesson 10 minutes prior to the agreed time. If you do not turn up at the agreed time for your lesson, your instructor will wait 15 minutes and may deduct this from the total lesson time at the instructor’s reasonable discretion. If you turn up outside these times, your instructor may, in his/her reasonable discretion, choose not to proceed with the lesson and in such circumstances, you will be liable for the cost of the lesson.
2.6 While every endeavour is made to commence the lesson at the scheduled time and with the scheduled instructor, no responsibility can be taken for circumstances beyond our control that may delay the start time or result in a change of instructor. If circumstances beyond our control have delayed the start time of your lesson, we will offer you the full lesson time or, if that is not possible, we will offer you a lesson at another time.
2.7 You must comply with the instructions or directions of your instructor at all times, before or during a lesson.
2.8 We reserve the right to terminate a lesson if:
a. you engage in any behaviour that your instructor determines is reckless; or
b. you fail to comply with the instructions or directions of your instructor before or during a lesson; or
c. you fail to comply with any special conditions on your license, i.e. wearing of glasses/contacts
In the event that a lesson is terminated under the circumstances listed above, you will be required to pay the full cost of the terminated lesson.
2.9 Neither we nor our driving instructors accept any liability whatsoever for personal property that is left in any instructor-supplied vehicle.
2.10 Driving lessons cannot take place in your own vehicle unless you have at least one full lesson with us to assess your driving. After this assessment, if your instructor agrees to provide lessons in your own car, you warrant that your car is covered by compulsory third-party and comprehensive insurance. Neither we nor our driving instructors accept any responsibility whatsoever for traffic infringements or accidents resulting from a learner having driving lessons in their own car.

4. Driving Test
4.1 Your instructor will only present you to Service NSW if they deem you safe to sit your driving test.
4.2 Neither we nor our driving instructors accept any responsibility whatsoever if your driving test is cancelled due to any error(s) in your log book unless it is an entry we have made. Instructions on how to fill in the log book properly is presented in your log book so please use due diligence to make sure your logbook meets necessary requirements before attending your driving test.
4.3 If you are presented to Service NSW for a driving test by one of our instructors but your test is cancelled due to any error(s), omission(s) or fault(s) not caused by us including but not limited to the items listed below, your Driving Test Package fee will be payable in full.
a. Any error(s) or omission(s) in your log book (you are fully responsible regarding your log book as per clause 4.4)
b. You have booked a different test by mistake (eg Hazard Perception Test instead of Driving Test)
c. Your test is at a different time or location
d. Service NSW’s inability to take your test due to staff shortages or any other situation

5. Promotions, Discounts & Free tuition
Any discounts or free lessons are not transferrable or redeemable for cash.

 6. Purchase of Goods and Services
6.1 Prices and availability of our services are subject to change at any time without notice. The Art Of Driving reserves the right to correct pricing errors at any time.
6.2 You warrant to The Art Of Driving that all information given by you to us through this site (including your name, contact and address details, credit card details) are correct.
6.3 The Art Of Driving reserves the right to refuse service to anyone for any reason.
6.4 The availability of services may change from time to time due to unforeseen problems or unexpected demand. The Art Of Driving is not liable for any loss or damage whatsoever arising from failure to deliver or delay in delivery of any services.
8. Disclaimer
The information contained on this website is for general information purposes only. You must not rely on any statement contained on this website without taking specialist advice. While we endeavour to ensure the accuracy and completeness of the information contained on this website, we make no warranties and accept no responsibility for any loss or damage you may suffer as a result of your reliance on any part of it.

9. Access
Although we will do our best to provide constant, uninterrupted access to this website, we cannot and do not guarantee this. We accept no responsibility or liability for any interruption or delay.

10. Governing Law
These terms and conditions are governed by the laws of New South Wales, Australia. We and you irrevocably submit to the exclusive jurisdiction of the courts of New South Wales.

Account Terms

This page contains the most current version of the Terms of Service.

• Accounts registered by “bots” or other automated methods are not permitted and will be removed.
• You are responsible for all activity that occurs from your account.
• You agree that The Art Of Driving can send you booking reminders, relevant information and other marketing via phone, SMS and/or email. You can opt-out of any marketing.
• You must not post or submit false information to the Service.
• You are responsible for maintaining the security of your account and password. The Art Of Driving cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
• You must not use the Service for any illegal or unauthorised purpose. You must not use this Service to violate any laws in your jurisdiction, including but not limited to copyright laws.
• The Art Of Driving has the right to suspend or terminate your account, refuse any current or future use of the Service, or any other The Art Of Driving service, for any reason.
• Violation of any of the terms or general conditions may result in the termination of your Account.

Cancellation Rates

• Less than 24 hours notice before the booking will forfeit the full booking fee.

A cancellation does not automatically refund payment of products or services. Any amount not subject to the cancellation fee, is credited towards your account balance at  The Art Of Driving.

Modifications to Services and Prices

• The Art Of Driving reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
• Prices of all Services are subject to change with or without notice.
• The Art Of Driving not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

Fees

• Credit card security is implemented using secure SSL encryption on all transactions and processed using a secure, trusted, PCI compliant payment gateway and used by The Art Of Driving for payment processing.
• All fees and transactions are in Australian Dollars.

General Conditions

• Your use of this website is at your sole risk. The website is provided on an “as is” and “as available” basis.
• You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website, use of the website, or access to the website without the express written permission by The Art Of Driving.
• Verbal, physical, written or other abuse (including threats of abuse or retribution) of any The Art Of Driving customer, employee, member, instructor, officer or external contractor will result in immediate account termination.
• The Art Of Driving does not warrant that (i) the website will meet your specific requirements, (ii) the website will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the website will be accurate or reliable, (iv) the quality of any products, websites, information, or other material purchased or obtained by you through the website will meet your expectations, and (v) any errors in the website will be corrected.
